We reserve the right to modify these Terms at any time. Changes will become effective immediately upon posting. Continued use of the Service after changes constitutes your acceptance of the new Terms.
3. Service Description
BeamBell provides businesses with an AI-powered conversational assistant for customer communication, including handling calls, scheduling appointments, answering queries, and more. The AI operates 24/7 and integrates with various third-party services such as calendars, CRMs, and payment systems.
4. Eligibility
To use our Service, you must be at least 18 years old or have reached the legal age of majority in your jurisdiction. You must have the authority to enter into legally binding agreements on behalf of your company.
5. Account Registration and Security
To access the Service, you may need to create an account. You agree to provide accurate and up-to-date information during registration and maintain the confidentiality of your account credentials. You are responsible for all activities under your account.
6. Usage Restrictions
You agree not to use BeamBell's Service for any illegal or unauthorized purpose. You also agree not to:
- Interfere with the functionality of the Service or disrupt its operation.
- Engage in data mining, scraping, or similar data gathering activities.
- Misuse the Service to transmit malicious software or spam.
- Reverse engineer or attempt to extract the source code of the Service.
7. Pricing, Payment, and Fair Usage
Subscription Packages: BeamBell offers several pre-made subscription packages that provide a set amount of services, including usage limits such as calls handled, API requests, and customer support features. The details and fees for these packages are listed on our website. Subscriptions renew automatically unless canceled before the renewal date. All fees are billed in advance and are non-refundable, unless otherwise specified.
Project-Specific Pricing: For businesses with unique needs, BeamBell also offers custom project-based pricing. In these cases, the pricing and terms, including any applicable usage limits, are tailored to the scope of the project and detailed in a personalized proposal. This agreement will outline all fees and any special conditions related to the usage of our services.
Fair Usage Policy: To ensure that all customers receive optimal service, BeamBell implements a Fair Usage Policy. For both subscription packages and custom projects, usage limits—such as the number of calls handled or minutes used—are specified in your plan or project agreement. We monitor service usage to ensure it stays within these limits.
Exceeding Usage Limits: If your usage exceeds the limits of your subscription package or project agreement, BeamBell reserves the right to:
- Charge additional fees for overages based on the terms of your plan or project agreement.
- Recommend upgrading to a higher plan or adjusting the project terms to accommodate increased usage.
- Temporarily limit or suspend access to features until usage returns to acceptable levels.
Billing and Payment: For subscription packages, payments are billed at the start of each billing cycle. For custom projects, billing terms will be outlined in the project agreement, with payments typically processed upon acceptance of the proposal and at agreed-upon milestones. You agree to provide valid payment information and authorize BeamBell to charge for all fees, including any overages.
8. Third-Party Services
BeamBell integrates with various third-party systems (e.g., calendars, CRMs, payment gateways). Your use of these third-party services is subject to their respective terms. We are not responsible for the functionality or security of these third-party services.
9. Data Privacy and Security
We are committed to protecting your data. Our Privacy Policy outlines how we collect, use, and secure your information. BeamBell uses encryption and industry-standard security protocols to ensure that your data is protected during transmission and storage.
10. Intellectual Property
BeamBell retains all rights, title, and interest in the Service and its content, including software, trademarks, and related materials. You are granted a limited, non-exclusive license to use the Service for your business purposes, but you may not reproduce, distribute, or create derivative works from the Service without our express consent.
11. Service Availability
BeamBell strives to maintain uninterrupted service but does not guarantee 100% uptime. Scheduled maintenance and updates may occur, and BeamBell is not liable for any interruptions caused by third-party systems, network failures, or other events outside of our control.
12. Limitation of Liability
To the maximum extent permitted by law, BeamBell is not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business interruption. Our liability is limited to the fees paid by you for the Service in the six months preceding the event giving rise to the claim.
13. Termination
We reserve the right to suspend or terminate your access to the Service if you violate these Terms or engage in fraudulent or harmful activities. You may also cancel your subscription at any time, but fees paid are non-refundable unless otherwise specified.
14. Indemnification
You agree to indemnify and hold BeamBell harmless from any claims, damages, or expenses arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Seattle, Washington, and you consent to the jurisdiction of these courts.
